Bihar Caste Reservation: On June 20, the Patna High Court invalidated amendments adopted by the Bihar Legislative Assembly in 2023 that increased the reservation from 50% to 65% for Scheduled Castes and Scheduled Tribes (SC/ST), Other Backward Classes, and Economically Backward Classes. The Supreme Court heard a challenge to this order. The Supreme Court, however, has declined to uphold the reservation. There is a report on this in India Today.

On June 20, a Patna High Court bench invalidated the changes made by the Bihar Legislative Assembly in 2023. However, in accordance with Articles 14, 15, and 16 of the Constitution as well as the Post and Services (Amendment) Act of 2023 and the Bihar (Admission to Educational Institutions) Reservation (Amendment) Act of 2023, the Court invalidated the Bihar Reservation for violating the Article of Equality.

The Bihar administration, led by Chief Minister Nitish Kumar, then appealed the High Court’s ruling to the Supreme Court on July 2. November 2023 saw the passage of the Reservation Amendment Bill by the Bihar Legislative Assembly. Nitish Kumar did not attend the state assembly when the law was enacted.

What was the Reservation Bill for Bihar?

The Bihar Government’s quota Amendment Bill states that the quota percentages for Scheduled Castes and Tribes have increased from 10 to 2 percent, OBCs from 18 to 25 percent, and OBCs from 16 to 20 percent. The overall reservation amount is 75% when this 65% reservation is added to a 10% reservation for economically disadvantaged areas. There will be a remaining 25% of seats available for the open category.

What is the reason for the rise in bookings?

Beginning in January 2023, the Bihar government carried out a two-phase caste-wise survey. It was discovered that there were 27.03 percent of OBCs and 36.01 percent of Atimagas in the population. This indicates that around 63% of the population was classified as OBC. It was discovered that the population of scheduled tribes was 1.68 percent, and the population of scheduled castes was 19.65 percent. The percentage of people in the upper caste was 15.52 percent. Of the 2.76 crore people in Bihar, 94 lakh, or 34.17 percent, are poor families whose monthly income is less than Rs 6,000.Therefore, along with planning other welfare schemes, the government of that place also decided to increase the castewise reservation in proportion to the population.
